A contract is a legally binding exchange of promises or agreement between parties that the law will enforce. It is an unfortunate reality in today’s business world that few deals can still be done “on a handshake.” Nonetheless, an organized and well-written contract can actually reduce the expense spent on attorneys by providing a clear, definitive relationship between the contracting parties. By setting up a good contract from the beginning, this reduces the possibility of legal disputes later on.
The need for negotiating, drafting and enforcing contracts can run the gamut from simple vendor or supplier contracts to complicated license or assignment agreements. Since contract law is constantly evolving as the business environment becomes more advanced, having an experienced legal team to consult with is a valuable asset to any business or individual. RECENT ACHIEVEMENT: NB recently won a jury trial on behalf of a manufacturing client over the sale of the assets of a business division. The defendant company claimed NB’s client breached the Asset Purchase Agreement by not delivering all of the required assets. Through information obtained during pretrial investigation and discovery, NB was able to establish that the defendant did, in fact, receive all of the assets. The jury unanimously found in favor of NB’s client, awarding well over $200,000 on a $150,000 Asset Purchase Agreement.
